Purpose – The purpose of this paper is to analyse the current status of ownership of patient information from a Lockean perspective and then present Datenherrschaft as a new model for patient ownership of patient information. Design/methodology/approach – This paper is theoretical in approach. It is based on arguments derived from Locke’s Two Treatises of Government. Legal examples of the current situation are derived from Finnish, UK and Swedish legislation. Findings – Current legislation concerning patient information is not clearly formulated (...) and so recognising a new right on the part of the patient, Datenherrschaft, would be an ethically justifiable way of remedying the issue. Research limitations/implications – The legal analysis was limited to Finland, the UK and Sweden, and so other legislation should be looked at in future research. Datenherrschaft is used as an example of an ethically justified way of regulating patient information ownership and should be analysed further. Originality/value – Patient information ownership is an issue that is not unambiguously solved in many countries, nor has it, in our view, been ethically justified. The potential solution presented in this paper is clear and has strong ethical justifications. (shrink)

Is the tendency to morally prioritize humans over animals weaker in children than adults? In two pre-registered studies (N = 622), 5- to 9-year-old children and adults were presented with moral dilemmas pitting varying numbers of humans against varying numbers of either dogs or pigs and were asked who should be saved. In both studies, children had a weaker tendency to prioritize humans over animals than adults. They often chose to save multiple dogs over one human, and many valued the (...) life of a dog as much as the life of a human. While they valued pigs less, the majority still prioritized ten pigs over one human. By contrast, almost all adults chose to save one human over even one hundred dogs or pigs. Our findings suggest that the common view that humans are far more morally important than animals appears late in development and is likely socially acquired. (shrink)

The main thesis of this paper is that we sometimes are disposed to accept false and even jointly inconsistent claims by virtue of our semantic competence, and that this comes to light in the sorites and liar paradoxes. Among the subsidiary theses are that this is an important source of indeterminacy in truth conditions, that we must revise basic assumptions about semantic competence, and that classical logic and bivalence can be upheld in the face of the sorites paradox.

Moral and political philosophers no longer condemn harm inflicted on nonhuman animals as self-evidently as they did when animal welfare and animal rights advocacy was at the forefront in the 1980s, and sentience, suffering, species-typical behavior, and personhood were the basic concepts of the discussion. The article shows this by comparing the determination with which societies seek responsibility for human harm to the relative indifference with which law and morality react to nonhuman harm. When harm is inflicted on humans, policies (...) concerning negligence and duty of care and principles such as the ‘but for’ rule and the doctrine of double effect are easily introduced. When harm is inflicted on nonhumans, this does not happen, at least not any more. As an explanation for the changed situation, the article offers a shift in discussion and its basic terminology. Simple ethical considerations supported the case for nonhuman animals, but many philosophers moved on to debate different views on political justice instead. This allowed the creation of many conflicting views that are justifiable on their own presuppositions. In the absence of a shared foundation, this fragments the discussion, focuses it on humans, and ignores or marginalizes nonhuman animals. (shrink)

The paper explores two ways in which the logic of questions might aid in the understanding of explanations. First, the "logic" of question-answer sequences imposes constraints on what answers are acceptable for an inquirer. Secondly, there are field- specific type-requirements built into questions. There is always more to a question than meets the potential answerer's ear. It is argued that, since there are nonepistemic presuppositions of why-questions, there are no interesting necessary and sufficient conditions for all explanations. The concepts we use to value and prescribe are historically contingent, and we could have found ourselves with others. But what does it mean to say that some concepts are better than others for purposes of action-guiding and deliberation? What is it to choose between different normative conceptual frameworks?

The role that trust plays in blockchain-based systems is understood and portrayed in various manners. The blockchain technology is said to enable and establish trust as well as to redirect it, to substitute for it, and to make it obsolete. Furthermore, there is disagreement on whom or what users have to trust when using the blockchain technology: code, math, algorithms, and machines, or still human actors. This paper hypothesizes that the divergences of the depictions largely rest on implicitly adhering to (...) different accounts of trust. Thus, the goal of this paper is to outline how the current lack of a shared understanding of the term “trust” leads to diverging interpretations of the blockchain technology’s core features. Furthermore, it shows how this lack of common understanding obstructs scholars from referring to one another meaningfully in the discourse on blockchain technology. To do so, this paper outlines the most prominent depictions of the setup of relevant trust relationships within blockchain-based systems and traces their roots to different underlying assumptions on the nature of trust. Supervaluationism, traditionally conceived, is the conjunction of three theses: Vagueness in a language gives rise to there being a multitude of acceptable assignments of semantic values to some expressions of the language, These assignments correspond to possible completions of the meanings of vague expressions, Truth is truth under all acceptable assignments, and falsity is falsity under all acceptable assignments. Supervaluationism has three chief virtues. It preserves classical logic. It provides an account of what vagueness is. And it extends nicely to (...) the vagueness of singular terms. I argue, however, that the existence of vagueifiers ‐ expressions like‘roughly’– pose problems for thesis of Supervaluationism, and that the supervaluationist can get around these problems only at a serious cost. Toward the end of the paper, I present an alternative analysis of vagueness, which preserves the main virtues of Supervaluationism, but which identifies vagueness as semantic Overdetermination, rather than as semantic underdetermination. In the summer of 1998, the Wisconsin State legislature amended its child protection laws. Under new child abuse provisions, Wisconsin judges can confine pregnant women who abuse alcohol or drugs for the duration of their pregnancies. South Dakota enacted similar legislation almost simultaneously. The South Dakota statute requires mandatory drug and alcohol treatment for pregnant women who abuse those substances and classifies such activity as child abuse. In addition, the South Dakota legislation gives relatives the power to commit pregnant women (...) involuntarily for two days; a court order can place the pregnant women in custody for up to nine months. These recent legislative “successes” follow scores of failed attempts by legislators in other states to establish fetal protection laws aimed at women who use and abuse drugs and alcohol during pregnancy. The aging process involves changes in immune regulation, i.e. adaptive immunity declines whereas innate immunity becomes activated. NF‐κB signaling is the master regulator of the both immune systems. Two recent articles highlight the role of the NF‐κB system in aging and immune responses. Adler et al1 showed that the NF‐κB binding domain is the genetic regulatory motif which is most strongly associated with the aging process. Kwon et al2 studying HIV‐1 infection and subsequent immune deficiency process demonstrated that HIV‐1 Tat (...) protein binds to SIRT1 protein, a well‐known longevity factor, and inhibits the SIRT1‐mediated deacetylation of the p65 component of the NF‐κB complex. As a consequence, the transactivation efficiency of the NF‐κB factor was greatly potentiated, leading to the activation of immune system and later to the decline of adaptive immunity. These observations support the scenario where immune responses and aging process can be enforced by the potentiation of NF‐κB transactivation efficiency. Longevity factors, such as SIRT1 and its activators, might regulate the efficiency of the NF‐κB signaling, the major outcome of which is inflamm‐aging via proinflammatory responses. In what follows, I want to discuss two particular—though broad—topics that have been raised by recent advances in cognitive science and science studies. First, the role of creativity in scientists’ self-understanding has changed dramatically through centuries and, with help from our friends in cognitive science, it is now possible to go beyond the so-called scientific imagination. I shall also suggest that creativity requires persistence over a long period. In our times of immediate gratification, this is an increasingly difficult mental disposition (...) to promote. Secondly, although discovery and creativity are seemingly drifting apart, it turns out that discoveries have a historical depth which creativity lacks. I distinguish two kinds of contribution that have been made by recent minimalist accounts of joint action in philosophy and cognitive science relative to established philosophical accounts of shared intentional action. The “complementarists” seek to analyze a functionally different kind of joint action from the kind of joint action that is analyzed by established philosophical accounts of shared intentional action. The “constitutionalists” seek to expose mechanisms that make performing joint actions possible, without taking a definite stance on which functional characterization (...) of joint action is the appropriate one. I elucidate the contrasting methodological underpinnings of these minimalist research programs in accordance with Bechtel and Richardson’s account of the heuristics of decomposition and localization as a research strategy for the study of complex systems. This paper argues for theoretical modeling and model-construction as central types of activities that philosophers of social ontology engage in. This claim is defended through a detailed case study and revisionary interpretation of Raimo Tuomela’s account of the we-perspective. My interpretation is grounded in Ronald Giere’s account of scientific models, and argued to be compatible with, but less demanding than Tuomela’s own description of his account as a philosophical theory of the social world. My approach is also suggested to be (...) applicable to many other methodologically naturalist accounts of collective intentionality and social ontology. (shrink)

In this paper I propose to examine, and in part revive, a time-honoured perspective to inquiry in general and scientific explanation in particular. The perspective is to view inquiry as a search for answers to questions. If there is anything that deserves to be called a working scientist's view of his or her daily work, it surely is that he or she phrases questions and attempts to find satisfactory answers to them.

New data-driven ideas of healthcare have increased pressures to reform existing data infrastructures. This article explores the role of data governing institutions during a reform of both secondary health data infrastructure and related legislation in Finland. The analysis elaborates on recent conceptual work on data journeys and data frictions, connecting them to institutional and regulatory issues. The study employs an interpretative approach, using interview and document data. The results show the stark contrast between the goals of open and Big Data (...) inspired reforms and the existing institutional realities. The multiple tensions that emerged during the process indicate how data frictions emanate to the institutional level, and how mundane data practices and institutional dynamics are intertwined. The article argues that in the Finnish case, public institutions acted as sage-guards of public interest, preventing more controversial parts from passing. Finally, it argues that initiating regulatory and infrastructural reforms simultaneously was beneficial for solving the tensions of the initiative and analysing either side separately would have produced misleading accounts of the overall initiative. The results highlight the benefits of analysing institutional dynamics and data practices as connected issues. (shrink)

Finland is internationally known as one of the leading centers of twentieth century analytic philosophy. This volume offers for the first time an overall survey of the Finnish analytic school. The rise of this trend is illustrated by original articles of Edward Westermarck, Eino Kaila, Georg Henrik von Wright, and Jaakko Hintikka. Contributions of Finnish philosophers are then systematically discussed in the fields of logic, philosophy of language, philosophy of science, history of philosophy, ethics and social philosophy. In his recent article "Carnapian Frameworks" (Synthese, 2021), Gabriel Broughton criticizes my discussions of Carnap on ontology and puts forward his own interpretation of what Carnap’s external/internal distinction amounts to. I here first argue that Broughton’s main claims about me are based on a misinterpretation. Then I turn to some issues of broader interest. I argue that Broughton’s own, potentially interesting interpretation of Carnap’s external/internal distinction does not work. The main question of the paper is that ofwhat vagueness consists in. This question must be distinguished from other questions about vagueness discussed in the literature. It is argued that familiar accounts of vagueness for general reasons failto answer the question ofwhat vagueness consists in. A positive view is defended, according to which, roughly, the vagueness of an expression consists in it being part ofsemantic competence to accept a tolerance principle for the expression. The article is an extended critical discussion of Kevin Scharp’s Replacing Truth. Scharp’s case for the claim that the concept of truth is inconsistent is criticized, and so is his case for the claim that the concept of truth must be replaced because of its inconsistency.

Mark Johnston and Eric Olson have both pressed what Johnston has dubbed the personite problem. Personites, if they exist, are person-like entities whose lives extend over a continuous proper part of a person’s life. They are so person-like that they seem to have moral status if persons do. But this threatens to wreak havoc with ordinary moral thinking. For example, simple decisions to suffer some short-term hardship for long-term benefits become problematic. And ordinary punishment is always also punishment of the (...) innocent, since it punishes personites that didn’t exist when the crime was committed. An initially attractive way around the personite problem may be to simply deny that personites exist. But as I discuss in this talk, relating to contemporary discussions in metaontology, this response for principled reasons doesn’t work. The problems I discuss illustrate the significance of metaontological considerations for issues in ethics and metaethics, and generalize widely beyond the personite problem. (shrink)

In Passive Obedience Berkeley argues that we must always observe the prohibitions decreed by our sovereign rulers. He defends this thesis both by providing critiques against opposing views and, more interestingly, by presenting a moral theory that supports it. The theory contains elements of divine - command, natural - law, moral - sense, rule - based, and outcome - oriented ethics. Ultimately, however, it seems to rest on a notion of spiritual reason — a specific God - given faculty that (...) all rational human beings have. Berkeley’s work on immaterialism, for which he is better known, could thus perhaps best be seen as an attempt to find a scientific justification for his moral doctrine. (shrink)
